I. General provisions

The privacy policy specifies how the personal data of Users necessary for the provision of services by electronic means are collected, processed and stored via the website https://www.kaczestawy.pl/ (hereinafter: the Service).

The Service collects only personal data necessary for the provision and development of the services offered in it.

Personal data collected through the Website are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as GDPR) and the Act on the protection of personal data of 10 May 2018.

III. Purpose of collecting personal data

Personal data is used for the following purposes: registration of the account and verification of the User’s identity, enabling login to the Website, execution of the agreement on services and e-services, communication with the User (live chat, contact form, etc.), sending the newsletter (after the User’s consent to receive it), running a comment system, providing social services, promotion of the Administrator’s offer, marketing, remarketing, affiliations, personalization of the Website for Users, analytical and statistical activities, debt collection, establishing and pursuing claims or defending against them. The provision of data is voluntary, but necessary for the conclusion of the agreement or the use of other functionalities of the Website.

IV. Type of personal data processed

The Administrator may process the User’s personal data: name, date of birth, address, e-mail address, telephone number, NIP.

V. Period of processing of personal data

Users’ personal data will be processed for the period of:

  • when the basis of data processing is the performance of the contract – until the limitation period of claims after its performance,
  • when the basis of data processing is consent – until its withdrawal, and after the withdrawal of consent until the limitation period of claims.

In both cases, the limitation period is 6 years, and for claims for periodic benefits and claims relating to the conduct of business – 3 years (unless the special provision provides otherwise).

VI. Sharing of personal data

Users’ personal data may be transferred to: entities related to the Administrator, its subcontractors, entities cooperating with the Administrator, e.g. companies handling e-payments, companies providing courier/postal services, law firms.

Your personal data will not be transferred outside the European Economic Area (EEA).

VII. Rights of Users

The user of the Website has the right to: access to the content of their personal data, rectify them, delete, limit processing, transfer, object to processing, revoke consent at any time (which does not affect the lawfulness of processing made on the basis of consent before its withdrawal).

The Administrator shall comply or refuse to comply with the request immediately – within a maximum period of one month from its receipt.

The user has the right to lodge a complaint with the President of the Office for Personal Data Protection, if he considers that the processing violates his rights and freedoms (GDPR).

VIII. Cookies

The Website collects information using cookies – session, permanent and external cookies. The collection of cookies supports the proper provision of services on the Website and serves statistical purposes. The user can determine the extent of access of cookies to their device in the browser settings.

IX. Automated decision-making and profiling

Users’ data may not be processed in an automated manner so that any decisions could be taken as a result. Users’ data can be profiled in order to adapt the content and personalise the offer after their consent.

X. Final decisions

The Administrator has the right to make changes to the Privacy Policy, whereby the rights of Users will not be limited. Information about the changes will appear in the form of a notice available on the Website. In matters not regulated in this Privacy Policy, the provisions of the GDPR and the provisions of Polish law apply.
