§1 General rules
- The Regulations define the rules for the provision of services by electronic means by the KACZE STAWY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ Centre with its registered office in Nowęcin, ul. Żwirowa 24, 84-360 Nowęcin, entered in the National Court Register under the number KRS: 0000596565, NIP: 8411740754, REGON: 540529550 (hereinafter the “Centre”).
- The administrator of the website and personal data is KACZE STAWY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.

§2 Definitions
- Services provided by electronic means – services provided by the Centre by means of electronic communication, in particular through the website.
- Customer – a natural person, legal entity or organizational unit using the Services provided electronically by the Center.
- Website – an internet service operated by the Centre, allowing the use of the Services electronically, available at: www.kaczestawy.pl
- Payment operator – the entity operating the system enabling electronic payments;
§3 Types and scope of services
- The Centre provides the following services electronically:
- Booking accommodation online;
- Sending the newsletter;
- Contact form;
- Handling Customer Inquiries.
- The use of the Services requires access to the Internet and a web browser that supports cookies.
§4 Terms and conditions of service provision
- The use of the Services electronically is voluntary.
- The Customer undertakes to use the Services in a manner consistent with the law and the Regulations.
- The provision of illegal content is prohibited.
- In order to use some Services, you may be required to register with the Website.
§5 Personal data protection
- The administrator of the personal data of Customers is the Centre.
- Personal data is processed in order to provide the Services, in accordance with the principles set out in the Privacy Policy available on the website.
- The Service Provider processes personal data in accordance with the applicable law, in particular with Regulation (EU) of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Regulation on the protection of personal data) hereinafter referred to as “GDPR” and the Act on the provision of electronic services.
- On the basis of Art. 13 GDPR the Service Provider informs that:
- The administrator of the personal data of the Customer within the meaning of Art. 4 point 7 of the GDPR, provided in connection with the use of services provided electronically by the Service Provider, is the Resort KACZE STAWY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Nowęcin, ul. 24, 84-360 Nowęcin, which can be contacted in writing at the above address, by telephone at the number: 48 602 577 710, by e-mail at the address: kontakt@kaczestawy.pl and via the contact form available on the website.
- The Service Provider has appointed a Data Protection Officer, with whom the Service Recipient can contact by e-mail at: kontakt@kaczestawy.pl.
- The Service Provider may process the data of the Service Recipient for the following purposes and legal bases:
- The correct performance of the Services provided electronically – the basis for the processing is the necessity of the processing for the performance of these Services (Art. 6 para. 1b GDPR);
- Advertising of the Service Provider’s products and services – the basis of the processing is the necessity of processing for the realization of the legitimate interest of the Service Provider which is the direct marketing of its own products and services (Article 6 para,1f) of the GDPR) and consent to the processing of data for marketing purposes in the future (Article 6 para.1a) of the GDPR);
- Pursuing claims – the basis of processing is the necessity of processing to pursue the legitimate interest of the Service Provider, which is the pursuit of claims (Art. 6 para. 1f GDPR); iv. Handling complaints – the basis of the processing is the necessity to fulfill the legitimate interest of both the Service Provider and the Service Recipient, which is the handling of the complaint process (Art. 6 par. 1f GDPR), v. Taking actions in connection with ensuring order and security and collecting evidence of violations of law and prevention – the basis of data processing is the necessity for processing to pursue the legally legitimate interest of the Services Provider, which are the protection of persons and property and the possibility of preventing and prosecuting crimes committed to the detriment of the Service Provider or the Service Recipient (Art. 6 Para 1f GDPR);
- Archiving, statistical, conducting market research and the behavior and preferences of the Service Recipient – the basis of processing is the necessity of processing for the realization of the legitimate interest of the Service Provider, which is to improve the quality of the Services provided electronically (Article 6(1)(f) of the GDPR).
- The Service Provider may disclose personal data of the Service Recipient:
- Entities providing the following services: human resources and accounting services, legal services, IT companies, agencies for the protection of persons and property, debt collection companies, entities providing telecommunication services, entities dealing with transactional and economic consulting, entities providing banking services, national payment institutions, entities acquiring receivables, entities managing receivables, entities providing monitoring services, entities conducting postal or courier activities, entities performing statistical analyses and traffic on websites, entities providing cleaning services, entities providing catering services, entities involved in organizing events for children and adults, entities cooperating in the framework of marketing campaigns Service Providers, entities to whom personal data will be transferred based on the express consent of the Service Recipient;
- To state authorities or other entities authorized by law, in order to perform the obligations incumbent on the Service Provider.
- Personal data is not and will not be transferred to a third country or international organisation.
- The Service Provider will store the Customer’s personal data for the entire period of using the Services provided electronically, and after the Customer submits a resignation from the Services (including withdrawal) or their termination – for a period of 6 years from the end of the calendar year in which the Service period ended. The Service Provider ceases to process the data for the purpose of direct marketing if the Customer objects to such processing, as well as if it withdraws its consent to the processing of the data, in particular for the purposes of direct marketing in the future.
- The Customer has the right: i. Access to the data provided with the use of the Service and their rectification, erasure or restriction of processing; ii. To transfer the data, i.e. to receive from the Service Provider the data provided to him in a structured, commonly used format suitable for machine reading, if they are processed for the purpose of concluding and performing the Service or on the basis of consent and the processing takes place in an automated manner. The Customer has the right to transfer this data to another data controller; iii. Submit a complaint to the supervisory authority dealing with the protection of personal data.
- The Service Recipient has the right to object to data processing at any time if the basis for processing is the legitimate interest of the Service Provider. In particular, the Service Recipient has a right to object to the processing of data for direct marketing purposes.
- The customer has the right to withdraw his consent at any time, if the basis for processing is consent. Withdrawal of consent does not affect the lawfulness of the processing, which was carried out on the basis of consent before its withdrawal. Consent can be withdrawn in any form, including: in writing to the address given above, by telephone at 48 602 577 710 or by e-mail to: kontakt@kaczestawy.pl.
- The provision of personal data is voluntary, however it is a necessary condition for the use of the Services provided electronically by the Service Provider. The provision of data for marketing purposes is voluntary.
- Personal data of the Service Recipient is not subject to automated decision-making by the Service Provider, including profiling
§6 Complaint
- Complaints regarding the Services should be submitted in writing to the Centre’s address: ul. 24, 84-360 Nowęcin, by e-mail to: kontakt@kaczestawy.pl or by telephone at: 48 602 577 710
- The complaint should contain at least: a) the name and contact details of the person making the complaint; b) a description of the problem and the circumstances justifying the complaint; c) the date of the incident and the booking number (if applicable).
- The Service Provider undertakes to consider the complaint within 30 working days from the date of its receipt. In justified cases, the deadline may be extended, of which the Customer will be informed.
- The Customer will be informed of the outcome of the complaint by means of the communication channel indicated in the complaint (e-mail, phone, letter).
§7 Final decisions
- The Service Provider reserves the right to change the Terms and Conditions. The Service Provider will inform about any changes to the Terms and Conditions by publishing a new version on the website www.kaczestawy.pl
- In the event that the Terms and Conditions apply to the concluded Agreements for the delivery of the Newsletter, the change can only take place for an important reason. Important reasons include, in particular:
- Change of the provisions of the law or their interpretation by public authorities, which affects the content of the Regulations;
- Imposition of new obligations on the Service Provider by public authorities that affect the content of the Rules;
- Change of the data of the Service Provider;
- Change of the scope of the services provided;
- Prevention of abuse or improvement of the operation of the Service;
- Improvement of the privacy of the Service Users;
- Introduction of changes beneficial to the Service Users.
- Changes to the Terms and Conditions do not affect sales contracts concluded before the date of their entry into force.
- In matters not regulated in the Regulations, the provisions of generally applicable law apply.
- In the event of a contradiction between these Terms and Conditions and the specific regulations concerning individual offers of the Service Provider, the provisions of the specific regulations shall prevail.
- These Terms and Conditions are effective from the date of publication.
